Both replaced the former Bankstown and Canterbury instruments after the merger. DCP chapters are amended separately from one another, so the version of one chapter tells you nothing about the currency of another.

The Schedule 1 trap

The most expensive mistake made in this LGA is concluding that a use is prohibited because it isn't in the zone's land use table.

Canterbury-Bankstown permits a number of specific uses on specific mapped land through Schedule 1 of the LEP and the clause application map. Those permissions appear nowhere in the land use table. An assessment that reads the table, finds nothing, and stops has missed a permission that exists — and conversely, a proposal that relies on a Schedule 1 permission has to identify the mapped area and plead it properly rather than assume it applies.

The same reasoning runs through change of use generally here. A use absent from the land use table has three more routes before it's dead: Schedule 1, a State policy that permits it independently, and existing use rights under Division 4.11. See change of use, which sets all four out.

Variations and the panel

Canterbury-Bankstown sees a high volume of applications and a correspondingly structured assessment process. Two consequences worth planning for.

A development standard variation under clause 4.6 needs both limbs argued — that compliance is unreasonable or unnecessary in the circumstances of the case, and that there are sufficient environmental planning grounds to justify the contravention. A request that argues only the first is a request that can be refused on its own terms, and here it will be.

Beyond a certain scale of departure, applications are referred to the local planning panel rather than determined under delegation. That changes the timeframe and the audience, and it changes how the statement of environmental effects should be written. Knowing before lodgement which of those you're facing is worth a good deal.

Flood and contamination

The Georges River and Cooks River corridors put substantial parts of the LGA on flood control lots, which generally closes complying development. And on any industrial site changing to a more sensitive use, contamination has to be addressed under the Resilience and Hazards SEPP — this LGA has enough industrial history that it comes up regularly rather than occasionally.
