Why Council Timeframes Blow Out in NSW (And How Small Developers Can Take Back Control

The brutal reality of council delays for small developers

If you’re a small residential developer or builder in NSW, you already know one thing: time kills deals.

Interest keeps ticking. Rates don’t stop. Buyers move on. Every extra month your DA sits in someone’s inbox at council is money out of your pocket.

What used to be a fairly predictable 40–60 day process can now stretch much longer, particularly in busy LGAs or where documentation is incomplete.

So what’s actually going wrong?

1. Under-resourced councils and overloaded planners

Most NSW councils are dealing with:

  • More applications

  • More complexity (new SEPPs, new Design Guides, constant policy changes)

  • The same or fewer planners That means:

  • Slower initial allocation of your DA to a planner

  • Longer gaps between “we’ve received your application” and real feedback

  • Increased reliance on template RFIs (Requests for Information) to “pause the clock” You can’t fix council staffing levels. But you can control how easy you make your project to assess.

2. The NSW Planning Portal isn’t a magic speed button

The NSW Planning Portal was sold as a way to streamline everything. In practice, for many developers it feels like:

  • A confusing interface
  • Inconsistent use between councils
  • Delays because council officers aren’t always actively monitoring or triaging portal submissions If your documentation is unclear or scattered (multiple versions, inconsistent drawings, vague reports), the portal becomes yet another place your project stalls instead of a fast-track.

3. RFIs: the quiet killer of your timeline

A single poorly-prepared DA can trigger:

  • Initial RFI from council administration (missing forms, incorrect fees, wrong owners)
  • Follow-up RFI from the assessing planner (non-compliant setbacks, privacy, overshadowing)
  • Separate RFIs from internal teams (stormwater, traffic, heritage, trees, urban design) Each RFI can add weeks, especially when consultants are slow to respond or need to redo reports.

Most RFIs are preventable with:

  • A clear planning strategy
  • Good quality control before you lodge
  • Drawings and reports that talk to each other instead of contradicting each other

4. Political and neighbour pressure

Even compliant or “sensible” projects can get bogged down when:

  • Councillors are sensitive to local objections
  • There are hot-button issues (trees, heritage streetscapes, parking)
  • Social media noise or petitions scare decision-makers Smaller developers often underestimate how much presentation and communication matter, not just compliance.

How Planland helps you get ahead of council delays

Planland can’t fix council staffing, but we can make your project:

  • Easier to understand

  • Clearly compliant (or clearly justified)

  • Less likely to need multiple rounds of RFIs We do that by:

  • Choosing the right path: CDC first, DA when it really pays offIf your project can run through CDC, we usually push that first to avoid council altogether.

  • When DA is unavoidable, we design with the local DCP and LEP in mind from day one, not as an afterthought.

  • Tight documentation and coordinationRevit-based drawings that are consistent across plans, sections and elevations

  • BASIX, stormwater, and engineering reports coordinated to match your drawings

  • Clear planning reports that explain the logic so planners don’t have to dig

  • Pre-empting the common RFIsShadow diagrams that actually answer the overshadowing tests

  • Privacy measures clearly marked (screens, sill heights, window types)

  • Landscaping, deep soil and private open space all set out in a way council is used to seeing

  • Giving you realistic time and risk expectationsWe can’t promise a council will hit its “official” timeframes

  • But we can give you a realistic view of best case / worst case so you can plan finance and holding costs properly

The takeaway for small developers

You’ll never fully control council timeframes in NSW—but you can massively reduce the risk of blowouts.

  • Pick CDC whenever it genuinely works
  • When you go DA, go in with a clear strategy and coordinated documentation
  • Treat RFIs and portal uploads as critical, not afterthoughts Planland’s role is to sit between you, your consultants and council, so your next DA or CDC isn’t a shot in the dark.
